Just yesterday, Joe Biden suggested that we have term limits on Supreme Court Justices. He now says he is against it but the judges could move to other courts.
What is the difference? The Justices were given lifetime appointments so they could not be fired for political reasons. Yet, that is exactly what Joe Biden is proposing.
Biden has spent months avoiding saying if he would pack the court. From what we are hearing now, he is ready to go full steam ahead in packing all the courts and not just the Supreme Court.
The Democrats are preparing for a hostile takeover of the federal judiciary. Once they do, I believe they will bring back the lifetime appointments.
Biden told the press that he was against term limits, but that he was considering a proposal to move Supreme Court justices to different courts:
No, no no no no. There is a question about whether or not — it’s a lifetime appointment. I’m not going to attempt to change that at all. There’s some literature, among constitutional scholars, about the possibility of going from one court to another court, not just always staying the whole time on the Supreme Court. But i have made no judgment, my word, my word is I have made no judgment, they’re just just a group of serious constitutional scholars, have a number of ideas how we should proceed from this point on. And that’s what we’re going to be doing. I’m going to give them 180 days, God willing, if I’m elected from the time I’m sworn in, to be able to make such a recommendation.
The reason that justices be rotated to other courts is a simple one. To apply term limits would require an amendment to the constitution.
The constitution says that federal judges serve for life, but does not guaranty them a spot on the Supreme Court.
They can be moved to another court without violating the constitution.
But, who decides which judges get sent down and which ones get to stay? No doubt the Democrats are plotting a way that they can control the process.
In the first place, the legislative branch of government should not be reshaping the legislative branch. That has to be unconstitutional because the three sections of our government must remain separate from each other.
The case could make it’s way ironically to the Supreme Court. If that happens, the majority will kill it and Justice Roberts can’t save the Democrats agenda anymore.
