Justice Clarence Thomas, one of the greatest SCOTUS justices of my lifetime, said that the US Supreme Court might be “the most dangerous” branch of the government and he warned an audience during a speech at the University of Notre Dame against “destroying our institutions because they don’t give us what we want, when we want it.”
In other words, when leftists can’t get something they want through the democratic process, say through Congress, or a state legislature, they turn to judicial activists to do it for them. That’s why Roe v Wade is not a real law. The abortion folks couldn’t get it passed by the legislative process because not enough Americans wanted it to be legal, so they got the court to do it for them, and courts can not create laws.
Justice Thomas has been criticizing judges for ruling cases based on their ideology, in that they want to act like politicians and legislators to support the Left’s ideologies. Thomas warned that judges should not make policy or base their decisions on personal feelings, or even religious beliefs.
“The court was thought to be the least dangerous branch and we may have become the most dangerous,” Thomas said, NBC-6 reported. “And I think that’s problematic.
“It’s not about winning and losing at the court. It is about the entire country and the idea of this country.”
The only “winner” should be the US Constitution. The problem we have is conservatives believe in the Constitution, but the leftists do not. In fact, they believe the Constitution is an obstacle to the ability of the government to help people. It’s not the government’s role to help people outside of protecting their liberty.
The Washington Post – where democracy goes to die – reported Thomas said the nation’s leaders should not “allow others to manipulate our institutions when we don’t get the outcome that we like,”
The judge quoted his late grandfather as saying, “After you’ve done that, and now what? What’s your next step?”
Thomas reflected on his childhood in the segregated South and his religious faith, and several times alluded to the political polarization in the US.
“We’ve gotten to the point where we’re really good at finding something that separates us,” Thomas told the audience of more than 800 students and faculty who were gathered at the school’s Performing Arts Center, the Post reported.
Thomas is a Catholic, and the Catholic church is against abortion. On Thursday,the Justice was asked if there were times when he had to resolve legal questions that conflicted with his Catholic faith. Thomas said for him, it has not been a problem. He said he had some cases that were very hard, especially early on in his career, but he added “that’s not the role of a judge.” Amen!
“There are some things that conflict very strongly with my personal opinion, my policy preferences, and those were very, very hard, particularly early on,” he said.
“I don’t do a lot of hand wringing in my opinions and tell people, ‘Oh, I’m really sad.’ That’s not the role of a judge. You do your job and you go cry alone.”
It’s a shame leftist judges don’t feel the same way, because they vote ideology every single time. They only reference the Constitution when they think it helps their leftist cause.
Thomas blames the mainstream media for helping to politicize the court.
“I think the media makes it sound as though you are just always going right to your personal preference,” he said. “So, if they think you are anti-abortion or something personally, they think that’s the way you always will come out.
“They think you’re for this or for that. They think you become like a politician. That’s a problem. You’re going to jeopardize any faith in the legal institutions.”
The courts already jaded my faith. We have three justices – four if you count Roberts – who will rule leftist ideology on anything political. It’s just a given.
I used to think that we had to maintain our conservative decorum, our belief in the Constitution and the rule of law, and that we would prevail over the leftist threat. I was such a young fool then. I learned over the years that the Left makes everything in their lives political. There is nothing sacred to them. It’s all political. So now I have come to the conclusion that the only way to defeat them is to do the same thing. I believe conservative judges need to start pushing a constitutional ideology, but hey, that’s actually their job, right?
Thomas is the longest sitting justice on the High Court, a Court that became more conservative under President Donald Trump, who was able to get three justices confirmed to that bench. Thomas gave his speech on Thursday at the alma mater of his newest colleague on the court, Amy Coney Barrett, who graduated from Notre Dame Law School and was a member of the faculty there.
