Finally, a judge has the guts to stand up and declare what we have all known for years, the Obama/Biden administration’s DACA program is illegal because the very premise is unconstitutional.
A president may not grant illegal aliens rights or rather new rights that are not supported by the law or by the constitution. Their companion program, DAPA had already been ruled unconstitutional for the very same reason.
But, when it came time for the Supreme Court to decide the fate of DACA, came after Antonin Scalia had died and the decision was 4 to 4 meaning the last court to hear the case would see their ruling stand up. It will surely go back to the court and we will have to wait and see how they rule this time.
Conservatives outnumber liberals by a 6 to 3 count but that may not mean a thing since some of the new alleged conservatives on the court have made decisions that coincided with the liberals.
U.S. District Judge Andrew Hanen ruled that the DACA program was illegal because Congress never authorized it. Obama put the program into effect by himself. Bu8t, Obama must be really jealous of Biden. Since he has taken office 1.1 million illegal aliens have entered the country. The Democrats are adding language to the boondoggle known as the Infrastructure Bill that will give millions of illegals a path to citizenship. Obama could only dream of doing that.
Obama said:
“I am president, I am not king. I can’t do these things just by myself. We have a system of government that requires Congress to work with the Executive Branch to make it happen,” he said during a 2010 interview with Univision. “I’m committed to making it happen, but I’ve got to have some partners to do it. … The main thing we have to do to stop deportations is to change the laws.”
But, that was exactly what Obama did, not taking his own advice. The judge’s ruling forbids the government from signing up anyone new to DACA and when the current DACA recipients have reached the end of their time, they will not be able to renew as they have done under Obama and Trump when an activist judge claimed that DACA was the law of the land.
In September 2017, President Trump ended DACA—when there were roughly 700,000 DACA recipients in the United States—and called on Congress to come up with a solution legislatively. Democrats didn’t attempt to work with Republicans on compromise legislation, and in June of last year, the Supreme Court ruled against the Trump administration’s efforts to end the program, citing procedural issues, effectively reinstating the program.
Current DACA recipients won’t have their temporary amnesty pulled, and won’t be deported as a result, but according to the Wall Street Journal, Judge Hanen’s ruling puts DACA in jeopardy.
